Privatdetektiven A hade följt med B:s förehavanden i syfte att skaffa utredning för ett anhängigt tvistemål, i vilket B var part, och härvid fotograferat B då denne vistades på gårdsplanen till sitt egnahemshus. A:s förfarande ansågs vara i SL 24 kap. 3 b § 2 mom. avsedd olovlig observation.
